Right to Withdraw Waiver

Background

Under Directive 2011/83/EU of the European Parliament and of the Council on Consumer Rights (“CRD”), consumers who purchase digital content or digital services from a business using a distance contract (such as an online transaction) ordinarily have a 14-day right to withdraw from the contract without giving any reason and without incurring any cost beyond those provided for in the Directive.

Waiver

At the time of purchase, you expressly requested that delivery of the digital content begin immediately — before the expiry of the 14-day withdrawal period. You confirmed this request by ticking the consent checkbox, which stated:

“Begin delivery immediately. I give express consent to start now and understand this ends my 14-day right to withdraw.”

Pursuant to Article 16(m) of the CRD, by providing this express consent and acknowledging that you would thereby lose your right to withdraw once delivery commenced, you waived your right to withdraw from the contract.

This consent was recorded at the time of purchase together with: (a) the exact timestamp, (b) the version identifier of this waiver text in effect at that time, and (c) your IP address at the time of checkout.

Effect

Once VIP Synergy dispatches your portal access link, delivery of the digital content is deemed to have commenced. From that moment, the right to withdraw from the contract no longer applies to your purchase and no refund obligation arises solely on grounds of withdrawal.

This waiver does not affect any other statutory rights you may have, including rights in respect of digital content that is faulty, not as described, or not fit for purpose under applicable EU and national consumer protection law.
